01 GENERAL & VIDEO CONTENT
The Fun Factor is an online comedy format based in Malta. By accessing our platform, you agree to these terms.
Our unique double-screen format (2 × 3:4 frames) presents each clip in a new visual context, paired with another clip, set to original music, and framed by our graphics and mascot. This transformative use may qualify as fair use under applicable copyright laws.

Fair Use Notice: Our use of short clips is transformative: (a) new comedic works, (b) entertainment/commentary, (c) not commercial exploitation, (d) no market effect. Each clip is edited and placed in our double-screen context.
02 CLIP CONTEST — RULES & LICENSE
Participation
By participating, you declare under penalty of disqualification that:
- You are the sole and exclusive owner of all rights to the submitted clip.
- The clip contains no third-party rights (music, logos, recognizable people without consent).
- You are at least 16 years old (under 18 requires parental consent).
License Grant
You grant Fun Factor a non-exclusive, worldwide, royalty-free license to use, edit, transform, and distribute your clip. Submissions may be cropped, trimmed, muted, overlaid with graphics, or combined with other clips as part of our double-screen format. The final video is our creative work, not yours. You retain ownership of your original clip.
Indemnification
You indemnify Fun Factor against all claims arising from intellectual property disputes regarding your submission. If someone else claims ownership of your clip, you handle it — not us.
Consequences of misuse: Immediate disqualification, removal of your clip, exclusion from future contests, and potential legal action for intentional fraud.
03 PRIZES, PAYOUTS & COMPLIANCE
Prize Determination
The subscriber count on the first day of the competition (00:00 UTC) determines the prize tier. Subsequent subscriber growth during the competition does NOT increase prizes. All prizes are paid within 30 days after winner announcement.
Source of Funds (YouTube Compliance)
All contest prizes are paid EXCLUSIVELY from sponsor income. YouTube AdSense revenue is NEVER used for community payouts. This complies with YouTube's Terms of Service, which prohibit sharing AdSense directly with viewers.
Example: Contest starts at 250K subscribers. You submit a clip. By month-end we reach 400K. The winner still receives the 250K prize (€200 + 20×€20 runners), NOT the 500K prize.
Legal note: YouTube does NOT allow sharing AdSense with subscribers. We reserve an EQUAL amount from sponsor income. AdSense itself stays frozen in a separate account. This is legally compliant and fully transparent.
04 COPYRIGHT & DISCLAIMERS
For Rightful Owners
Are you the rightful owner of a clip appearing in our videos? Contact us at legal@joinfunfactor.com. We respond within 48 hours and take appropriate action within 7 days.
Disclaimer of Warranties
THE FUN FACTOR PROVIDES SERVICES "AS IS" WITHOUT ANY WARRANTIES. WE DO NOT WARRANT that services will be uninterrupted, error-free, or that submitted clips will win or be featured.
Limitation of Liability
Fun Factor shall not be liable for any damages arising from service unavailability, third-party claims regarding submitted material, or lost opportunities. All investments (time, money, effort) are at your own risk.
Note: Due to our unique double-screen format and creative transformation, our use may fall under fair use or quotation rights. Nevertheless, we take all requests seriously.
05 LAW & UPDATES
Applicable Law
The Fun Factor is based in Malta. These terms are governed by Maltese law. Any disputes shall be submitted exclusively to the competent court in Malta.
Changes to These Terms
We reserve the right to modify these terms at any time. The most current version is always on this page. Your continued use after changes constitutes acceptance.

06 ADVERTISEMENTS
Wall of Ads
The Fun Factor offers 2000 unique numbered ad spots on our homepage. Each spot is rented for a minimum of 12 months. Payment is required in advance. Ad spots are non-refundable. We reserve the right to refuse or remove content that violates our standards.
Billboards
Premium billboard space (16 spots across TOP, MID, and ESSENTIAL ranges) is rented monthly. Priority placement is first-come, first-served. We provide a mockup service for an additional fee.
Sponsor & Advertiser Terms
- All payments are final. No refunds for early termination.
- We reject ads with hate speech, illegal products, or misleading claims.
- Locked pricing is honored only for continuous, uninterrupted renewals.
- Charity contributions (20% of sponsor income) are calculated on after-tax profit and distributed quarterly.
- We do not guarantee specific view counts or conversion rates.
07 COMMUNITY PROFIT SHARING
Ambassador & Community Earner Programs
Ambassadors and Community Earners receive monthly payouts based on performance. Payouts are calculated monthly and paid within 30 days after month-end. Minimum payout thresholds apply. Terms are subject to change with 30 days notice.
Source of Funds – YouTube Compliance
All community payouts are paid EXCLUSIVELY from sponsor income. YouTube AdSense revenue is NEVER used for community payouts. This complies with YouTube's Terms of Service.
How it works: YouTube pays AdSense to Fun Factor → Amount goes to Account 1 (frozen). Fun Factor takes the SAME amount from sponsor income → Account 2 (community payouts). AdSense is never shared. Legally waterproof.
Taxes: All payouts are gross amounts. Participants are responsible for taxes in their jurisdiction. Fun Factor does not withhold taxes.
08 CHARITY & DONATIONS
The Fun Factor is not a registered foundation. We operate as a commercial entity that donates a portion of its profits to charitable causes (DAN's Wigs and DAN's Kids Sports).
- 20% of after-tax sponsor income is donated quarterly.
- 50% of after-tax merchandise profit is donated quarterly.
- We are not a tax-deductible charity. Your purchase is a commercial transaction, not a donation.
- We reserve the right to change supported charities with 30 days notice.
- Donations are made after taxes and operational costs. No specific purchase is directly tied to a specific donation.
Transparency: Quarterly financial reports are available upon request.
09 NO INVESTMENT GUARANTEE
The Fun Factor is a creative project, not a financial investment vehicle. We do not guarantee:
- Specific subscriber growth or channel performance
- Return on investment for advertisers or sponsors
- Projected revenue figures (all projections are estimates)
- Continued platform availability (YouTube may change policies)
Any participation, whether as advertiser, ambassador, or earner, is at your own risk. Past performance does not guarantee future results.
Important: We are transparent about our goals and progress, but we cannot predict YouTube algorithms, market changes, or other external factors. Your participation is a belief in our mission, not a guaranteed financial return.

YouTube AdSense Compliance
The Fun Factor fully complies with YouTube's Terms of Service regarding AdSense revenue sharing. YouTube AdSense revenue is NEVER shared with the community. All contest prizes, ambassador payouts, community earner rewards, giveaways, quest prizes, and jackpot payouts are paid EXCLUSIVELY from sponsor income. AdSense itself remains frozen in a separate account and is never distributed.
In simple terms: AdSense stays in the bank. Sponsor money pays the community. The amount is the same, but the source is different. This is legally compliant and fully transparent.
